1. Acceptance of Terms
By accessing or using our website and services (the “Site”), including submitting inquiries or making bookings for lodging or events, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to book lodging or events through the Site.
3. Services Provided
The Site may allow you to:
- Check availability and request or complete hotel room reservations
- Request or complete banquet, conference, meeting, and event bookings
- Submit inquiries, obtain quotes, and communicate with our team
- Purchase add-ons (e.g., breakfast packages, AV, catering, parking)
We may change or discontinue any portion of the Site at any time.
4. Reservations and Booking Conditions
4.1 Hotel Room Reservations
Room reservations are subject to:
- Availability and confirmation
- Minimum stay requirements and blackout dates (if applicable)
- Check-in/check-out times: 4PM and 11AM
- Guest limits and occupancy rules
- House rules (noise, smoking, pets, etc.)
4.2 Banquet / Conference / Event Reservations
Event reservations (including meeting rooms, banquet halls, catering, and conference services) may require:
- A signed Event Agreement (or contract) and/or credit authorization
- Deposits, payment schedules, minimum spend, and guaranteed counts
- Policies for setup/teardown times, staffing, and AV requirements
- Compliance with capacity limits and safety rules
If there is any conflict between these Terms and a signed Event Agreement, the Event Agreement controls for that event.
5. Pricing, Taxes, Fees, and Charges
Prices shown may:
- Exclude applicable taxes (e.g., occupancy tax, sales tax), service charges, gratuities, and facility fees
- Be subject to change until your booking is confirmed
- Include incidentals (hotel) and damages/cleaning fees (hotel/events)
You are responsible for all applicable taxes and mandatory charges.
6. Payments and Authorization
By providing a payment method, you authorize us (and our payment processor) to charge:
- Room charges, deposits, and applicable taxes/fees
- Event deposits, scheduled payments, and approved charges
- Incidentals and damages where permitted by law and disclosed in advance
If a charge fails, we may cancel a reservation or suspend services.
7. Cancellations, Changes, and Refunds
7.1 Hotel Cancellations/Changes
Cancellation/change rules depend on the rate type and dates booked. Your confirmation will show your specific policy.
7.2 Event Cancellations/Changes
Event cancellations are governed by your Event Agreement. Common terms may include:
- Non-refundable deposits after a certain date
- Sliding cancellation fees closer to event date
- Guaranteed minimum attendance counts due by a deadline
- Charges for special-order items, staffing, AV, or custom work already performed
7.3 Force Majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., natural disasters, government actions, utility outages, labor disputes). If a force majeure event occurs, we will work with you in good faith on rescheduling or other options, subject to any signed agreement and applicable law.
8. Guest Conduct and Property Rules
You agree not to:
- Violate laws or hotel/event rules
- Damage property or disrupt other guests/events
- Bring hazardous materials or illegal substances
- Use the Site for fraud or unauthorized access
We may refuse service, cancel bookings, or require removal for unsafe or disruptive conduct, as allowed by law. You will be liable for any damage you cause to hotel property.
9. Event-Specific Policies
If applicable, your Event Agreement may include:
- Outside Vendors: approval requirements, insurance COI, load-in rules
- Food & Beverage: no outside food/drink unless approved; allergy disclosures; last-call policies
- Alcohol: compliance with licensing laws; ID checks; right to refuse service
- Decor/Equipment: restrictions on open flames/confetti; wall attachments; damage responsibility
- Noise & Hours: quiet hours; end times; overtime fees
- Security: required for certain guest counts or alcohol service
10. Accuracy of Information
We try to keep information accurate, but availability, pricing, packages, and descriptions may change. The Site is provided “as is” and may contain errors.
11. Intellectual Property
All content on the Site (text, images, logos, design) is owned by or licensed to us and may not be used without permission.
12. Third-Party Services and Links
We may use third-party services (maps, booking engines, payment processors, analytics). We are not responsible for third-party sites or services outside our control.
13. Disclaimers
To the fullest extent allowed by law, the Site and services are provided “as is” without warranties of any kind, express or implied.
14. Limitation of Liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or bookings. Our total liability for any claim is limited to the amount you paid us for the relevant booking, unless law requires otherwise.
15. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Site, breach of these Terms, or violation of law.
16. Governing Law and Venue
These Terms are governed by the laws of New Jersey, USA without regard to conflicts rules. Venue for disputes will be in JAMS arbitration unless applicable law requires otherwise.
17. Changes to These Terms
We may update these Terms by posting a new effective date. Continued use of the Site means you accept the updated Terms.
